Former FDNY firefighter sentenced to prison for causing fatal collision in East Elmhurst while intoxicated and speeding: DA

Former FDNY firefighter Michael Pena was sentenced to four to 12 years in prison on Tuesday for the fatal high-speed collision that killed a young man on Northern Boulevard in East Elmhurst in February 2025.

Michael Pena, 29, of Oakland Gardens, was off-duty and driving while intoxicated when he sped through an intersection at three times the legal speed limit when he slammed his Mercedes-Benz into a car driven by 23-year-old Justin Diaz, who had the right of way,  just blocks from his family home as he drove to work at LaGuardia Airport.
