Wingate, Russotti, Shapiro & Halperin LLP, the personal injury and malpractice law firm, announced that associate Brielle C. Goldfaden recently settled a premises liability case for $130,000 after their 91-year-old client was injured when the automatic sliding doors in her apartment building closed on her, knocking her to the ground.
At the time of the accident, the client was leaving her apartment building to go food shopping when the sliding glass doors closed too quickly, hitting her body as she passed over the doorway threshold. As a result of her fall, she fractured her pelvis resulting in a five day hospitalization but, thankfully did not require surgery.
The building management company claimed there was nothing wrong with the doors and that their doormen inspected the sensors every day. The last inspection was supposedly only 4 hours before our client’s accident and the doors were working fine, so the building claimed they were not negligent and could not have known plaintiff’s accident was imminent.
At mediation, Brielle argued that more should have been done to prevent this accident, especially in a building with many elderly, slower-moving tenants. Ultimately, Brielle was able to obtain $130,000 recovery for our client’s pain and suffering.
