Colton Files Appeal to Stop Trash Plant

Assemblyman William Colton filed an appeal in state court to stop the city’s plan to build a garbage processing plant on the Bensonhurst waterfront, the Brooklyn Eagle reports.

The proposed plant is set for construction on the waterfront of the Gravesend Bay at Shore Parkway and Bay 41st Street. It’s been been in the planning stages since it was first announced as part of the city’s Solid Waste Management Plan in 2005.

Colton filed the original New York State Supreme Court in 2012, naming the New York City Department of Sanitation (DOS) and the New York State Department of Environmental Conservation (DEC) as defendants. City Councilmember Mark Treyger also supported the original lawsuit.

Colton’s legal arguments contended the plant would severely hinder the quality of life, public health, environment, and safety of the residents of Bensonhurst, Bath Beach, Gravesend, Sheepshead Bay, and Coney Island. But the court ruled against him in 2013.
